AGREEMENT TO OUR LEGAL TERMS

Omera is a mobile application operated by SIMMER DATING LTD (doing business as “Omera”, “we”, “us”, or “our”), a company registered in England and Wales with its registered office at:

Omera is a dating and social events application that helps users connect based on food preferences and shared interests, including participation in in-person events.

You can contact us at info@simmerdating.co.uk.

By accessing or using Omera, you confirm that you have read, understood, and agreed to these Terms and Conditions (“Terms”). If you do not agree, you must not use the Services.

Omera is intended for users aged 18 and over only.


1. OUR SERVICES

Omera is a dating and social events application that matches people based on food preferences and allows users to join or attend food-related in-person events.

Our Services are not intended for use in any jurisdiction where offering or using the Services would violate local law. If you access the Omera application from outside the UK, you are responsible for your own compliance.

We do not guarantee matches, relationships, or outcomes of any kind.


2. INTELLECTUAL PROPERTY RIGHTS

All intellectual property in the Services, including software, branding, content, and design, belongs to Simmer Dating Ltd or its licensors.

You are granted a limited, non-exclusive, revocable licence to use Omera for personal, non-commercial purposes only.

You must not:

  • copy, modify, translate, or distribute Simmer Content

  • reverse engineer or decompile the App

  • use the App to create a competing service

All rights not expressly granted are reserved.


3. USER REPRESENTATIONS

By using Omera, you confirm that:

1.      You confirm that you are at least 18 years old. Omera enforces its 18+ policy through mandatory date of birth entry and phone-based authentication. We reserve the right to suspend or permanently remove accounts where we reasonably believe a user is under 18 or has provided false age information.

  1. you have the legal capacity to enter into these Terms

  2. the information you provide is accurate and kept up to date

  3. you will not use automated tools (bots, scrapers, scripts)

  4. you will not use Omera for illegal, abusive, or harmful purposes

  5. you will comply with all applicable laws

If you provide inaccurate or misleading information, or misuse the Service, we may suspend or terminate your account.


4. USER REGISTRATION

Omera uses secure third-party authentication. You may register using:

  • mobile phone number (one-time SMS code)

  • Google

  • Apple

  • Facebook

Omera does not create or store passwords.

  • You are responsible for safeguarding access to your device and linked accounts, notifying us if you believe your account is compromised

 

We may modify or remove display names or profile content that we consider misleading, offensive, or inappropriate.


5. PROHIBITED ACTIVITIES

You agree not to:

  • harass, abuse, threaten, or harm other users

  • create multiple or deceptive accounts

  • impersonate any person

  • upload pornographic, sexually explicit, or violent content

  • scrape, harvest, or attempt to gather personal data

  • interfere with events or in-app experiences

  • distribute malware or harmful code

  • circumvent any security features

  • use the App for advertising or commercial activity without approval

  • sell or transfer your profile

·         engage in fraud, scams, or attempts to obtain money or financial information

 

·         engage in coercive, controlling, or exploitative behaviour

 

·         share or threaten to share intimate images without consent

 

·         encourage or promote self-harm or suicide

 

·         make credible threats of violence

We may remove content or suspend accounts that violate these Terms.


6. USER-GENERATED CONTENT

You may upload:

  • profile photos

  • dish photos

  • prompts and text

  • event-related contributions

  • other content you choose to share (“Contributions”)

Your Contributions:

  • must be your own or you must have the right to use them

  • must not be illegal, abusive, discriminatory, or harmful

  • must not infringe any third-party rights

  • may be visible to other users of the Service

Private messages between users are not shared publicly


7. CONTENT LICENCE (OPTION B)

You retain ownership of your Contributions.

You grant Simmer Dating Ltd a non-exclusive, worldwide, royalty-free licence to:

  • host, store, display, and process your Contributions to operate and improve Omera

  • use public-facing content only (profile photos, dishes, prompts, display name) for Omera’s own marketing and promotional purposes

This licence does not permit:

  • use of private messages

  • sale or sublicensing of your content

  • using your identity in paid advertising without further consent

You may withdraw marketing permission at any time by contacting info@simmerdating.co.uk.

 

You retain full ownership of all your Contributions.

We may remove, edit, or restrict access to content that breaches these Terms.


8. MOBILE APPLICATION LICENCE

You may install and use the App on devices you own or control.

You must not:

  • reverse engineer, decompile, or modify the App

  • use the App to generate revenue or run a competing service

  • circumvent technical protections

  • interfere with server operation

App Distributors (Apple/Google) are not responsible for maintaining the App


9. THIRD-PARTY ACCOUNTS

If you log in using Google, Apple, Facebook, or another supported provider:

  • we receive basic profile information (e.g., name, email, profile photo)

  • we do not access your friend lists, contacts, email address book, or other private data

  • your data is handled according to our Privacy Policy

You may disconnect a third-party login method via your device or by contacting us.


10. THIRD-PARTY LINKS

Omera may link to third-party websites or services. We are not responsible for their content or practices.


11. MODERATION

We operate proportionate systems and processes to reduce the risk of illegal activity on Omera. This includes automated moderation tools, user reporting mechanisms, and account review processes. While we do not proactively review every message, we review reported content and take appropriate action where necessary.

We will:

  • monitor activity on the Services

  • remove content that breaches these Terms

  • suspend or disable accounts

  • report unlawful activity to authorities and cooperate with law enforcement or regulatory authorities where required by law.

  • We may use automated tools to detect and prevent the upload or transmission of content that violates these Terms.

Simmer dating ltd is not able to proactively monitor all content or messages.


LOCATION DATA

Omera uses location information solely to enable core platform functionality, including event discovery and local relevance.

Precise Location (Device GPS – Session Only)

With your permission, Omera may access your device’s precise location while the app is actively in use.

Precise location data:

  • is processed locally on your device

  • is not stored on our servers

  • is not retained after the session ends

  • is not linked to your account identity

Precise location is used only to:

  • display nearby events

  • improve event relevance based on proximity

You may disable precise location access at any time via your device settings.

City-Level Location (Stored)

During profile setup, you provide or confirm your city.

City-level location:

  • is stored as part of your profile

  • does not include exact GPS coordinates

  • is used to show relevant events and support geographic matching

Omera does not:

  • continuously track user location

  • store precise GPS coordinates

  • sell or share location data for advertising

  • use location for cross-app tracking

12. PRIVACY

Our Privacy Policy explains how we process personal data and forms part of these Terms:

13. COPYRIGHT INFRINGEMENT

If you believe content in the App infringes your copyright, contact us at info@simmerdating.co.uk with details. We will review and take appropriate action


 

14. TERM AND TERMINATION

We may suspend or terminate access at any time for breach of these Terms or to protect users or the platform.

You must not create new accounts after termination without permission


15. MODIFICATIONS & SERVICE INTERRUPTIONS

We may update or modify the Services at any time.

Omera may occasionally be unavailable due to maintenance or technical issues. We are not liable for downtime or loss resulting from interruptions.


16. GOVERNING LAW

These Terms are governed by the laws of England and Wales.
Courts of England and Wales have exclusive jurisdiction.


17. SAFETY & EVENTS DISCLAIMER

We do not conduct criminal background checks. We rely on user-provided information and third-party authentication methods.

You are solely responsible for your interactions with others, whether online or in person.

Attendance at events is at your own risk.

Simmer Dating Ltd arranges and curates private bookings at third-party venues. These venues operate independently and are responsible for their own staff, facilities, licensing, food preparation, and health and safety compliance.

We expect all attendees to behave respectfully and safely. We may remove or refuse entry to any attendee who breaches our Code of Conduct


18. EVENTS DISCLAIMER

Omera may allow users to attend or participate in in-person events.

Simmer Dating Ltd arranges and curates private bookings at third-party venues. These venues operate independently and are responsible for their own premises, staff, licensing, food preparation, and health and safety compliance.

Unless explicitly stated otherwise:

  • we do not provide security, transport, or medical services

  • we are not responsible for the conduct of other attendees

  • we are not responsible for conditions at third-party venues

You attend events voluntarily and at your own risk.

Nothing in these Terms excludes liability where it cannot be excluded under applicable UK law, including for death or personal injury caused by our negligence.


 

19. DISCLAIMER

The Omera app is provided “as is” and “as available”.

We do not guarantee:

  • uninterrupted or error-free operation

  • accurate or complete content

  • that users are who they claim to be

We are not liable for:

  • user behaviour

  • data breaches caused by third parties

  • any loss resulting from use of the Services

This does not exclude liability where it cannot be excluded under UK law


20. LIMITATION OF LIABILITY

To the extent permitted by law, Our total liability shall not exceed the greater of £100 or the amount you have paid to us in the previous 12 months.

We do not exclude liability for:

  • death or personal injury caused by our negligence

  • fraud or fraudulent misrepresentation

  • rights you have under UK consumer protection law

  • Breach of statutory duties under Online Safety Act

  • Data protection breaches


21. INDEMNITY

·         If your actions cause us loss (e.g., posting unlawful content, infringing third-party rights), you may be required to compensate us for reasonable costs and losses.


22. USER DATA

We may store data relating to your use of the Services.
While we take reasonable steps to protect it, we cannot guarantee that data will never be lost or corrupted.

We recommend backing up your own important data


23. ELECTRONIC COMMUNICATIONS

By using the Services, you consent to receive electronic communications from us. These satisfy legal requirements for written communication.


24. MISCELLANEOUS

If any part of these Terms is found unlawful or unenforceable, the rest remains in effect.

These Terms constitute the entire agreement between us and you.

We may assign our rights under these Terms; you may not.
